INTELLECTUAL PROPERTY COMPLAINT POLICY:

In Takesaky Shop, we provide a platform to sell our own creative products. The following details must be included in your notice:

  2. The Takesaky Shop’s campaign (or campaigns) URL(s) associated with the sale of the allegedly infringing items;
  3. Identification of the copyright, trademark, or other rights that allegedly have been infringed, including proof of ownership (such as copies of existing trademark or copyright registrations);
  4. Your full name, address, telephone number(s), and email address(es);
  5. A declaration that you have a good-faith belief the use of the content in the provided URL is illegal under federal or state law and that the owner of the rights, or its licensee, is not allowing it;
  6. A declaration that the information in the notification is accurate and complete, and that you are authorized to act on behalf of the holder of the allegedly infringed intellectual property or other right, made under penalty of perjury.

COUNTER-NOTICE POLICY

You can send a counter-notice to Takesaky Shop via support@takesaky.com when you realize that by error or misidentification, a claim of intellectual property infringement was made. You could be held responsible for the intellectual property owner’s losses (including expenses and legal fees) if you materially mislead in your counter-notice that your design does not violate any intellectual property.

Therefore, to prevent the worst situation, you can contact an attorney before filling the counter-notice, if you do not make sure about whether or not the material infringes on the intellectual property. When you send a counter-notice to Takesaky Shop, remember to include these important information:

  1. Your physical or electronic signature;
  2. Your full name, address, telephone number(s), and email address(es);
  3. Identification of the material and its location before it was removed, either by URL to the Takesaky Shop’s campaign(s) used in connection with the sale of the allegedly infringing merchandise or Takesaky Shop’s campaign number;
  4. A statement under penalty of perjury that the claim of intellectual property infringement that led to the removal or blockage of access to material was filed by mistake or misidentification;
  5. Your consent to the jurisdiction of a federal court in the district where you live (if you are in the U.S.), or your consent to the jurisdiction of a federal court in the district where your service provider is located (if you are not in the U.S.);
  6. Your consent to accept service of process from the party who submitted the takedown notice or an agent of that party.

After you have submitted a counter-notice, Takesaky Shop may send a copy of the counter-notice to the party who filed the original complaint advising them that Takesaky Shop has 10 working days to replace the removed content or stop disabling it. The withdrawn content might be updated or accessibility to it might be reinstated in 10-14 business days following receipt of the counter-notice, unless the intellectual property owner initiates a lawsuit against you asking for a court order.

REPEAT INTELLECTUAL PROPERTY COMPLAINT POLICY

Regardless of how many strikes are involved, Takesaky Shop has the right to delete accounts that violate the letter or spirit of the Terms of Service.
